ChexSystems Dispute

As you may already know, ChexSystems is regulated by the Fair Credit Reporting Act (FCRA); the same laws that govern the 3 major credit bureaus: Equifax, Experian, and TransUnion. Like your credit report, your ChexSystems report must also contain correct and verifiable information. If your ChexSystems report is accurate and contains no flaws, there isn’t much you can do. Only the passage of time, can ensure the removal of your name from ChexSystems, unless the reporting bank requests for the removal of your name. On the other hand, if your report does contain errors, you may file a dispute directly with ChexSystems.

Follow these steps to dispute your ChexSystems report:

1. Order a free copy of your ChexSystems report online. Look over your report, and make notes of all incorrect information.

2. Type up your dispute letter. (Remember to keep a copy for yourself)

Sample Dispute Letter to ChexSystems:

I was recently denied a bank account based on the information that ChexSystems maintains under my name and Social Security Number. Upon ordering a copy of my ChexSystems report, I noticed the following entry reported by Wells Fargo Bank:

Reported Name: John Smith
Reported Address: 123 ABC Street, CA 54321
Reported SSN/ID: xxx-xx-xxxx
Drivers License: xxxxxxxxx

Reported For: Non-Sufficient Funds (NSF) Activity

I have no knowledge of such an account, and it may have been reported due to error or identity theft.

Please validate this information with Wells Fargo Bank and provide me with copies of any documentation associated with this bank account bearing my signature. In the absence of any such documentation bearing my signature, I ask that this information be immediately deleted from the file you maintain under my name and Social Security Number.

3. Mail out your dispute letter via certified postal mail. Certifying your mail is vital to disputing any ChexSystems or credit report because it keeps a documented paper-trail of important dates. ChexSystems is allowed 30 days to respond to your dispute letter from the date they receive it. If you do not receive a response within that allotted time period, ChexSystems is under grounds to remove your record altogether. (Remember to keep all receipts from the post office)

4. If ChexSystems responds, and they claim to have correct and verifiable information about you, you can respond with another dispute letter. In the letter, ask them about the procedures involved in obtaining your personal information. Also, request the name, title, and phone number of the person they contacted in order to verify your information. By law, they must disclose this information to you. Afterall, you do have the right to know who reported you, and under what conditions.

5. If the response comes back with all the information you’ve requested, verify the information yourself. Make sure everything checks out with the source of the information. Ask them for documented evidence that bears your signature. You may be able to prove your innocence if there are signs of foul play or identity theft. If ChexSystems responds with no disclosed information, you may have to take matters to a higher authority. You can file a complaint with the Federal Trade Commission (FTC) by using this form.

    I opened an account online 2 years ago with BOA. A month after opening, my account was frozen. When I called in I was told it was overdrawn by $ 8888888. I had in my account $ 750 which were never returned by BOA and also they reported me to Chex.
    How can I get this sorted out because recently I was denied checking by Wells Fargo.

    what If Chex systems does not send the information pertaining to whom they spoke with at the bank etc? and what if the bank does not report that I am disputing the claim on my chex systems report? what should I do next? please advise

    What are you people slow this site is not ChexSystems they are not the ones that make you can’t open an account that is why they put up the steps to take to hopefully get your name cleared. Seriously people READ.

As is common with these sites however; if it is not disclosed that you’re not “officially affiliated with ChexSystems”; consumers become confused and the above noted comments become publicly posted as a result. While most are aware this is not a ChexSystems official site; this poses a serious threat to the privacy and protection of those who misunderstand.

    I was denied a bank account based on the inforation that chexsystems maintains under my name and social security number. I need this cleaned up soon has you can. The bank(RBC Bank) that I had the account with that put my name on this list has told me from their end Im ok to get a bank account but when any other bank pulls it up Im denied.

    I need my name remove from check system… why is my name in the system, been
    in since june 6 2007 and the case against me was dismissed by judge Anderson
    who is now retired! There is substancial evidence, yet I serve 63 days for false writing.

    • My name is Eddie Bansag. My account with chase bank had already been cleared per your letter to me dated Sept. 6, 2010 but until now, it is still showing on your record. I need my name cleared with your system because I cannot open a new account with Wells Fargo Bank.
