Bad Credit Bank Accounts

In most cases, you can open a bank account at any bank regardless of your credit.  This is because most banks and credit unions use ChexSystems to verify new accounts.  There are some banks that actually use both ChexSystems and a credit report, but this is not common.

Technically speaking, ChexSystems is a CRA (Consumer Reporting Agency) even though the data it collects is a bit different than the 3 major credit bureaus.  The main difference between the credit bureaus and ChexSystems, is that the credit bureaus (Experian, Equifax and Transunion) only keeps track of a consumer’s credit history, while ChexSystems maintains a database of banking histories.  And unlike the credit bureaus, ChexSystems does not keep records of accounts in good standings, which means it only keeps records of consumers who have had a negative banking history.

Negative banking histories can include accounts that have been reported for excessive NSFs, outstanding debt, account abuse and fraud.

So, can a person with terrible credit open a bank account?  Yes, as long as the bank does not pull your credit report.

Banks Getting More Lenient with ChexSystems Records as Economy Worsens

Credit card applicants are aware of credit bureaus and the “FICO” scores that impact their ability to obtain credit cards and the interest rates available to the individual, etc. Consumers have less understanding of and visibility into the mechanism used by “ChexSystems”, the organization that provides account-holder reliability data to banks, savings and loans, and other institutions that provide checking accounts to individuals.

The relative obscurity of the ChexSystems derives from two factors: one being that there is no pure “score” on record, and the other being that only negative consumer actions or “failures” are recorded, whereas credit account scores are positively influenced by balance payoffs, etc. Many individuals are negatively affected in terms of being refused a checking account on the basis of past history of overdrafts, bounced checks etc. reported by another institution to ChexSystems. These problems remain on record for five years, unless the reporting institution withdraws its report.

The best way to respond to a disapproved account application is to log on to www.chexhelp.com to investigate the source of negative information. It may be that a problem you have already corrected could have been cleared from your history except for the failure of the institution with which you had been dealing. ChexSystems also allows for consumers to post rebuttals or explanations for past account problems.

Lists of banks and S&L’s that are not part of the ChexSystems network are readily available form many Internet sources. Avoid any list sites that charge a “membership” fee. Many of these banks refer to their accounts as “second chance” accounts. About 20% of banks nationwide do not use ChexSystems.

ChexSystems-participating banks use the reports at their own discretion. During the last decade, due to heavy consumer criticism many banks became more lenient. Some institutions now ignore negative reports that are three years old as opposed to the five-year standard. Other banks have raised dollar level of unpaid overdrafts from $25 to $100 as a threshold for refusing an account.

Besides the aforementioned rebuttal/explanation approach one can use directly to ChexSystems, many individuals can gain relief by contacting the manager of the refusing institution. It is strictly their choice as to whether the ChexSystems report should be grounds for refusal. A successful request for leniency could be based on increased financial health of the individual or couple, or on many other factors including a questionable origination of the negative report.

The deep economic recession of he past few years is beginning to push more institutions towards greater leniency in using data from the reports. One reason is simply that there is a greater percentage of the populace that has ChexSystems records, and therefore a shrinking pool of “low-risk” account applicants. Banks need to accept new accounts to keep their financial base, and consequently must accept applicants with records that are marginally risky. That is, they may choose to accept applicants with minor problems in the system.

From the applicant’s perspective, the recession has produced tremendous turmoil in employment markets. Many who have lost a job and who required a period of time to obtain a new one have experienced unpaid bills, bank overdrafts, and other problems in the interim. Finding a new “permanent” position should restore the applicant to low-risk status for consideration for a new account, despite the reported problems.

Individuals without a steady source of income need to carefully consider any accounts that are available, since high-risk accounts often come with high fees that can compound financial difficulties.

Business Checking Accounts and ChexSystems

Running a business without a checking account is nearly impossible in this day and age.  But have no fear, there are options for people who are listed on ChexSystems, but need a business checking account.

Option 1:

Open a business checking account with a bank that does not use ChexSystems.  Most Non-ChexSystems Banks will check credit, Telecheck or some other verification system to verify new accounts, so you will have to ask the bank.

Option 2:

Open a business checking account with a bank that offers Second Chance Checking Accounts.  These banks will overlook your ChexSystems or Telecheck record, so approval rates are very high.  Second Chance Checking Accounts only work if you do not have a reported case of fraud.

Option 3:

Incorporate your business and open a business checking account using the business’ TIN instead of your Social Security Number.  TIN stands for Taxpayer Identification Number, and it is usually represented by the SSN (Social Security Number for individuals) or the EIN (Employer Identification Number for businesses).  To learn more about incorporating your business, check out LegalZoom or MyCorporation.

How long will I be listed in ChexSystems?

Do banks from other states check your ChexSystems record?

If you moved from one state to another, and wondering whether a bank will check ChexSystems, the answer is yes.  ChexSystems is a nationwide system, so if your name shows up in the database, it will be available to any member bank.

Does a ChexSystems report contain any positive information?

No, ChexSystems reports only contain negative information about someone.  A ChexSystems report may however, include a consumer statement describing their situation, much like a credit report.  So, in other words, someone with a good banking history will not appear in ChexSystems.

Can I get my name removed from ChexSystems?

Yes, but it’s not easy.  There are 2 situations when it is possible to get your name legally removed.  One, if the reporting bank requests the removal of your name.  Or two, if ChexSystems violates the law.

ChexSystems Removal

Getting your name cleared from ChexSystems is not an easy task.  In fact, most people who try fail.  Of course, you can try to hire a credit repair company to get your name removed, but even then, there are no guarantees of success.  And, once you’ve paid for the ChexSystems removal service, there are no refunds.  The reality is, you have the power to do anything that those credit repair companies can.  Credit repair companies have to abide by the same rules and regulations as you do.

Are you eligible for ChexSystems removal?  To find out, ask yourself these questions:

1.  Have you tried to talk to your bank’s branch manager to see if they’re willing to remove you from ChexSystems?

If so, then great!  However, in most cases, branch managers will not honor this request, unless there were some unique circumstances which caused you to be reported.  It wouldn’t hurt to try though.

2.  Is all the information correct on ChexSystems? 

Is your name, birthdate and social security information correct?  Is the reported information correct, such as amount owed, dates and name of the reporting bank? 
Once you have received your ChexSystems report, review it to see that there are no errors or inaccuracies.  If you do happen to find an error, you should file a dispute with ChexSystems.

3.  In your case, has ChexSystems stayed within all governing laws and regulations?

By law, ChexSystems has to follow all rules and regulations as mandated by the FCRA (Fair Credit Reporting Act).  If they are within the guidelines, then there isn’t much you can do from a legal perspective.

Class Action Lawsuit against ChexSystems

Date: 10/30/09

According to Attorney Lee Sherman of Callahan, Thompson, Sherman & Caudill LLP, ChexSystems is in violation of the Fair Credit Reporting Act (FCRA). The class action lawsuit alleges that ChexSystems is refusing or failing to add consumer dispute statements to the reports.

Currently, the lawsuit is in the information gathering stage.

Having been in this industry for a while now, I have seen some of the misspelled variations of the word “ChexSystems.”  Here are they are.

Second Chance Checking Account – Question Checklist

Before you apply for a second chance checking account, make sure to do some research on the service.  Ask questions and get all the facts upfront, so you’re not caught off-guard or end up paying any unnecessary fees.

Secured Credit Cards vs. Prepaid Debit Cards

Don’t worry – you’re not the only one confused by the many types of plastic cards. For the most part, people understand the difference between a debit card and a credit card. A debit card is a card that is connected to a bank account much like an ATM card. A credit card on the other hand, allows you to use credit (or borrowed money) based on your credit history. Ok, simple enough. But, what is a secured credit card and how does it differ from a prepaid debit card?

A secured credit card is a credit card in which a deposit is used as collateral for the credit that is extended to the borrower. For example, if a secured credit card requires a minimum deposit of $300, the issuing bank may offer you an initial credit of $300 or more. In most cases, the credit limit will at least match the amount of the minimum deposit.

The differences between a secured credit card and a prepaid debit card:

  • A secured credit card’s approval is partially based on your credit history, whereas the approval for a prepaid debit card is not based on a credit check.
  • With a secured credit card account, your credit is usually reported to the major credit bureaus, whereas a prepaid debit card may not be reported. This is dependent on which prepaid debit card you apply for.
  • A secured credit card account requires that you make a minimum deposit to open the account. The amount of money that you deposit upfront usually determines the amount of credit line that is offered to you. For prepaid debit cards, it works a little bit differently. Because credit is not a factor in the approval process of prepaid debit cards, credit is not extended to you. Instead, your available spending limit is set by the amount of money you have deposited or loaded onto your prepaid debit account.
  • Depending on the secured card issuer, interest may be paid on your deposit. A prepaid debit account not offer interest on your loaded funds.
  • A secured credit card does not allow direct deposit, while it does allow automatic payments. Most prepaid card issuers do give you the option of direct deposit.
  • A secured credit card charges interest just like a regular credit card. A prepaid debit card does not charge any interest.

Unfortunately, both types of cards come with fees. However, certain fees can be avoided with prepaid debit cards if you set up direct deposit.

Solutions to ChexSystems

There are 4 solutions to ChexSystems.  Here they are:

Non-ChexSystems Banks

Going with a Non-Chexsystems Bank may be the most popular method of overcoming ChexSystems. Non-ChexSystems Banks do not use ChexSystems to verify new bank accounts, so approval is usually based on some other criteria, such as credit history or Telecheck. Unfortunately, most people who are listed on ChexSystems also have bad credit which means that qualifying for a Non-ChexSystems Bank can sometimes be problematic.
Pro: Does not use ChexSystems.
Cons: May require a credit check.  Often times, these banks are small and do not have too many branch locations or ATMs.

Second Chance Checking Accounts

Second Chance Checking Accounts are checking accounts offered by some banks to help people get a second chance at banking. In most cases, applicants will be approved for a Second Chance Checking Account, unless there is a record of fraudulent activity on your ChexSystems file. While most Second Chance Checking Accounts do not issue checkbooks, there are still a handful of banks that offer the entire package. The complete package includes checkbook, debit card, online bill pay and most other services that come with a regular checking account. Due to the high level of risk for these types of accounts, banks normally charge a monthly fee which can range anywhere from $9 to $30.
Pro: High approval rate.
Con: Monthly fees.

Prepaid Debit Cards

Prepaid debit cards are quite similar to Second Chance Checking Accounts. Both offer a deposit account which allows you to withdraw or make payments via a debit card. Both are offered through a FDIC-insured bank and come with routing and account number. Both come with monthly fees and/or upfront fees. Despite the similarities, there are 2 possible distinctions. One, is that a Second Chance Checking Account may come with a checkbook, while a prepaid debit card will never include a checkbook. Two, is that prepaid debit accounts do not require a ChexSystems or credit check.
Pro: Does not use ChexSystems or credit + high approval rate.
Con: Monthly fees.

ChexSystems Record Removal

This is a viable option if you were reported in error, or if you can prove that there are inaccuracies in your ChexSystems record. Otherwise, it would be very difficult to get an accurate record removed from ChexSystems. There are basically 3 instances in which a ChexSystems record can be deleted. One, would be if the reporting bank requests the removal of your name. Two, if ChexSystems holds inaccurate information about you, it would legally have to be removed. Or three, if ChexSystems violates any of the provisions laid out by the FCRA (Fair Credit Reporting Act).
Pro: If successful, your name would be permanently removed from ChexSystems.
Con: Difficult to do if ChexSystems has accurate information.

Top 5 Misconceptions about ChexSystems

1.  Because ChexSystems is a CRA, everyone who has had a bank account gets reported to them.
False.  Only accounts with negative banking histories get reported to ChexSystems.

2.  ChexSystems records are held for 7 years or more.
False.  Unlike the credit bureaus, ChexSystems records are removed after 5 years.  If you are certain that you have been listed for more than 5 years and your record still remains, you should contact ChexSystems immediately to get it removed.

3.  A credit repair company or lawyer can more do than what I can do to dispute a ChexSystems report.
False.  Credit repair companies and lawyers have no more rights than you do.  Anything they can do – you can do. However, the advantage that the credit repair companies and lawyers have is their knowledge and expertise in the field of credit laws.  So, if you are good at research and have a keen eye for facts, then you should have no problem disputing ChexSystems on your own.

4.  ChexSystems decides whether I am approved for a bank account or not.
False.  It is ultimately up to the bank to approve or deny you for a new bank account (checking or savings).  ChexSystems simply provides the bank with the information that is used to make the decision.

5.  If I appear on ChexSystems, it is impossible to get a bank account.

What is Fresh Start Checking?

What is the Get Checking Program?

Get Checking™ is a national education program that qualifies you for a checking account regardless of a ChexSystems record. The program was originally developed in Wisconsin by a team of businesses, banks, and government agencies. The main purpose of Get Checking is to educate people on how to manage money effectively, and balance their checkbooks. Get Checking is sponsored by UW-Extension and eFunds Corporation (parent company of ChexSystems, Inc.).

About the Program

The Get Checking Program requires you to attend a six-hour seminar provided by a participating educational organization. Upon completion of the class, you will receive a certificate which states that you have successfully finished the program. By completing the program, you are also entitled to a ChexSystems report update which basically confirms that you have taken a consumer education course. With the certificate in hand, you’ll be able to open a new checking account at any participating bank or credit union. Your instructor will provide you with a list of participating banks and credit unions at the end of the class. The cost for enrollment is $50.

Who Can Apply for the Program?

The program is open to all consumers, however, it is only beneficial to people who have “non-fraudulent” activities reported on their ChexSystems report. Also, in order to qualify for a new checking account, you’ll have to satisfy all debts previously owed to your banks and/or credit unions.

Why Banks Use ChexSystems

Banks are in business to make money, not lose money which is why they rely heavily on ChexSystems reporting.  That said, if you default on a bank account with overdrafts or other unpaid fees (regardless of the cause or situations that led to this) you will likely wind up on the dreaded list of ChexSystems. 

What exactly is ChexSystems?

ChexSystems Inc. is a Consumer Credit Reporting Agency to the banking industry.  Their sole responsibility is to report negative information about a person or company’s banking history.  This data is supplied to banks to help them to gauge your risk level. 

ChexSystems is similar to your regular credit report – only it applies to your banking profile.  If you’ve been reported to ChexSystems it can remain on your financial profile for up to 5 years (even if you clear the debt).  And if banks and other financial institutions get a hold of this negative information about you, they have the right to deny you a new bank account.

Now be advised that ChexSystems Inc. doesn’t force banks to do anything.  Their whole job is simply act as a reporter of negative banking information.  Banks can choose to use this information as reason to deny you a bank account — or they can choose to ignore it and go ahead and grant you an account anyway.  But that’s a slim chance they’ll ever do that.  Banks are already in hot water as it is these days; they definitely don’t want to take any more chances of losing money and having another default on their books.
